Terms of Use
Applies to the Lexkite web app (lexkite.com), the Lexkite iOS/Android apps and the “Lexkite” browser extension. Effective date: October 17, 2026. See also our Privacy Policy.
These terms were prepared from a template. They are not legal advice and do not replace review by a qualified lawyer.
Lexkite™ is operated by MODIAN LUXURY JEWELRY LLC, a Wyoming limited liability company (“Lexkite”, “we”). By using the service you agree to these terms and to our Privacy Policy. If you do not agree, please do not use Lexkite.
1. The service
Lexkite is a free tool for learning English vocabulary and preparing for English tests. We may change, add or discontinue features to improve the product, and we may set daily limits on free features such as AI feedback.
2. Who can use Lexkite
You must be at least 13 years old to use Lexkite. If you are under the age of majority where you live (or under 16 in the EEA or the UK), you may sign in only with the consent of a parent or guardian, who accepts these terms on your behalf.
3. Accounts and data
- You can use Lexkite without an account; your learning data then stays only on your device.
- When you sign in with Google, your learning data is copied to our servers so it can sync between devices. You can export your data, delete it on your device or ask us to delete it from our servers at any time (see How to delete your data).
- You are responsible for keeping your Google account and your devices secure, and for backing up data that is stored only on your device.
4. Acceptable use
- Do not use Lexkite to send unlawful, abusive, hateful, sexually explicit or otherwise harmful content, including in AI features, Roleplay, leaderboard nicknames, problem reports and messages.
- Do not choose a leaderboard nickname that impersonates someone else or contains personal contact details.
- Do not intentionally overload, probe for vulnerabilities in, reverse-engineer or gain unauthorised access to our systems.
- Do not use bots, scripts or other automated tools to get around daily limits, scrape content in bulk or use AI features for purposes other than your own learning.
- We may limit, suspend or block access (for example with temporary rate limits) if these rules are broken or to protect the service and other users.
5. Your content
Content you create yourself (flashcards, example sentences, essays, speaking transcripts, messages) belongs to you. You give us a limited, worldwide licence to store, process and transmit it only as needed to provide the service, for example to sync it between your devices or to send it to our AI providers when you request feedback. If you send us feedback, ideas or problem reports, we may use them to improve Lexkite without any obligation to you. Do not submit content that you do not have the right to use or that contains other people’s personal information.
6. AI features and scores
- AI feedback, estimated band scores and Roleplay replies are generated automatically by third-party AI models (Google Gemini or Cloudflare Workers AI) and can be inaccurate, incomplete or inappropriate. Use them as practice guidance only.
- Practice test scores and estimated bands are for reference only. They are not official IELTS, TOEIC or TOEFL scores and are not issued or endorsed by the British Council, IDP, Cambridge University Press & Assessment or ETS. Lexkite does not guarantee that you will reach any particular score.
- Do not include sensitive or personal information in texts you submit for AI feedback.
7. Third-party services and content
Lexkite uses third-party services (for example Google Sign-In, Google Translate, dictionary and image sources, YouTube videos and speech recognition in your browser) and links to external websites. These are provided by their own operators under their own terms, and we are not responsible for their availability or content.
8. Advertising
Lexkite is free. To keep it free, we plan to show ads in the mobile apps and possibly on the website; no ads are shown today. Ads will not appear during lessons, tests or reviews, and the browser extension does not show ads. Ads are provided by Google and are subject to the choices described in our Privacy Policy. We are not responsible for the products or services advertised.
9. Intellectual property
Lessons, practice tests, model answers, the interface and the Lexkite brand are created and owned by Lexkite, except for the open data credited in our Privacy Policy (Open data credits), which remains under its own licence. You may use the content for your personal learning; do not copy it in bulk, redistribute it or resell it without permission.
“Lexkite”, the Lexkite logo and the Kit mascot are trademarks (™) of MODIAN LUXURY JEWELRY LLC. You may use the name “Lexkite” to refer to or link to the service accurately. Without our written permission, you may not use these marks or a confusingly similar name or logo for another product, app, domain name or account, or in a way that suggests we sponsor or endorse you.
10. Ending use
You can stop using Lexkite at any time and ask us to delete your account data. We may suspend or end access for users who break these terms, or discontinue the service; if we discontinue it, we will try to give reasonable notice so you can export your data.
11. Disclaimer
The service is provided free of charge, “as is” and “as available”. To the extent permitted by law, we make no warranties, express or implied, including about accuracy, fitness for a particular purpose or uninterrupted availability.
12. Limitation of liability
To the extent permitted by law, Lexkite is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or opportunities (including test results), arising from the use of or inability to use the service. Our total liability for any claim is limited to USD 50. Nothing in these terms limits liability that cannot be limited by law or your mandatory rights as a consumer.
13. App stores
If you download Lexkite from the Apple App Store or Google Play, these terms are between you and Lexkite, not Apple or Google, and the store’s own terms also apply. Apple and its subsidiaries are third-party beneficiaries of these terms for apps obtained from the App Store.
14. Changes to these terms
When these terms change, the effective date at the top of this page is updated. For important changes we will inform you in the app before they take effect. Continuing to use Lexkite after that means you accept the new version.
15. Governing law
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules and without prejudice to any mandatory consumer protection rights you have in your country of residence.
